Terms of Service

Welcome to SwipeRep. These Terms of Service ("Terms") govern your access to and use of the SwipeRep mobile app and website (the "Service"), operated by SwipeRep, Inc. ("SwipeRep," "we," "us"). By creating an account or using the Service, you agree to these Terms.

The short version: SwipeRep is a marketplace that connects homeowners with contractors. We don't perform the work ourselves and we're not a party to your agreements with other users. Be honest, be respectful, and pay your contractors.

1. Eligibility

You must be at least 18 years old and able to enter a legally binding contract. Contractors must be properly licensed and insured for the trades and jurisdictions they operate in.

2. Accounts

You're responsible for the accuracy of the information you provide and for keeping your login credentials secure.
One account per person or business. No impersonation, no fake reviews.
We may suspend or terminate accounts that violate these Terms.

3. The marketplace — what SwipeRep is (and isn't)

SwipeRep is a platform that helps homeowners and contractors find each other. SwipeRep is not the contractor. We don't perform the work, don't supervise the work, and aren't a party to the contract between you and the other user. Any agreement, quote, or job is solely between the homeowner and the contractor.

Contractors are independent businesses. You are responsible for verifying licensing, insurance, references, and the scope of work before hiring.

4. Subscriptions and billing (contractors)

Paid contractor plans (Pro, Elite, add-ons) are billed monthly through Stripe.
Free trials, if offered, convert to paid subscriptions unless cancelled before the trial ends.
You can cancel any time in the app — cancellation stops the next renewal. We don't pro-rate refunds for partial months unless required by law.
Prices may change with at least 30 days' notice for existing subscribers.

5. Payments between users

Payments for completed jobs are processed through Stripe. Homeowners are responsible for paying contractors for completed work. Disputes about scope or quality should first be resolved directly between the parties.

6. Acceptable use

You agree not to:

Post false, misleading, or fraudulent information.
Harass, threaten, or discriminate against other users.
Circumvent SwipeRep to avoid platform fees or move communications off-platform to evade safety/quality protections.
Scrape, reverse engineer, or attempt to access the Service in unauthorized ways.
Use the Service for any unlawful purpose.

7. Content and reviews

You retain ownership of content you upload (photos, profile info, reviews). You grant SwipeRep a worldwide, non-exclusive, royalty-free license to host, display, and distribute that content as needed to operate the Service.

Reviews must reflect a real experience with the matched user. We may remove reviews that violate these Terms.

8. Disclaimers

THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTY OF ANY KIND. SWIPEREP DISCLAIMS ALL IMPLIED WARRANTIES INCLUDING MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT. WE DO NOT GUARANTEE THE QUALITY, SAFETY, LICENSING, OR PERFORMANCE OF ANY CONTRACTOR OR THE INTENT OR ABILITY OF ANY HOMEOWNER TO PAY.

9. Limitation of liability

TO THE FULLEST EXTENT PERMITTED BY LAW, SWIPEREP'S TOTAL LIABILITY FOR ANY CLAIM ARISING OUT OF OR RELATING TO THE SERVICE IS LIMITED TO THE AMOUNT YOU PAID SWIPEREP IN THE 12 MONTHS BEFORE THE CLAIM. WE ARE NOT LIABLE FOR INDIRECT, INCIDENTAL, OR CONSEQUENTIAL DAMAGES.

10. Indemnification

You agree to indemnify SwipeRep against claims arising from your use of the Service, your content, your interactions with other users, or your violation of these Terms.

11. Termination

You may stop using the Service or delete your account at any time. We may suspend or terminate your access for violation of these Terms or for any reason with reasonable notice. Provisions that by nature survive termination (e.g., disclaimers, limitation of liability) will survive.

12. Dispute resolution

These Terms are governed by the laws of the State of Delaware, without regard to conflict of laws principles. Any dispute will be resolved by binding arbitration in accordance with the rules of the American Arbitration Association, except that either party may seek injunctive relief in court. You waive any right to participate in a class action.

13. Changes to these Terms

We may update these Terms periodically. Material changes will be communicated in-app or by email. Continued use of the Service after changes take effect constitutes acceptance.
